REFUND AND CANCELLATION POLICY
Nominal Designs LLC
Effective Date: October 13, 2026
1. Our Commitment
At Nominal Designs LLC, we aim to provide professional logo design, branding, and graphic design services that meet the agreed project brief.
Because our services involve customized creative work, refunds are assessed according to the stage of the project, the services already performed, the payment terms, and applicable law.
This policy applies to purchases made directly through our website or through other channels where Nominal Designs LLC’s own policies govern the transaction. If a third-party marketplace or payment provider imposes additional applicable rules, those rules may also apply.
2. Before Work Begins
If a client requests cancellation before we have started any substantive project work, we will assess the refund based on the agreed terms, any applicable non-recoverable expenses, and applicable law.
Where no work has started and no non-refundable expense has been incurred, we will generally refund payments received, less any deductions that are lawfully permitted and disclosed in advance.
3. After Work Has Started
Once work has commenced, a refund will take into account the work completed, project stage, and expenses reasonably incurred.
Depending on the circumstances, this may include:
* Creative research and discovery.
* Initial logo concepts or design directions.
* Brand identity development.
* Revisions and refinements.
* Preparation of final files.
* Approved third-party expenses.
Any deduction will be reasonable, supported by the project circumstances, and consistent with applicable law. We will not automatically retain the entire project fee merely because work has started.
4. After Concepts Have Been Delivered
If initial concepts or design drafts have been delivered, the client should first communicate any concerns and identify how the designs differ from the approved brief.
Where revisions are included in the agreed package, we will provide the applicable revisions within the agreed scope.
A client’s subjective preference for a different creative direction does not automatically entitle them to a full refund. However, we will consider genuine failures to provide the agreed service, material departures from the approved brief, and any other circumstances relevant under applicable law.
5. After Final Delivery
Once the agreed final deliverables have been supplied, refunds are generally not available solely because the client changes their mind, provided the services have been properly performed and no mandatory legal right to a refund applies.
If the deliverables are materially incomplete, defective, or inconsistent with the agreed scope, please contact us so we can assess the issue and determine an appropriate remedy.
6. Revision and Satisfaction Concerns
If you are dissatisfied with a design, contact us at the email address provided on our website.
Please include:
* Your name and project reference.
* A description of the issue.
* The relevant design or deliverable.
* The changes you believe are needed to meet the agreed brief.
We will review your concerns and, where appropriate, offer revisions, correction of errors, completion of outstanding work, or another reasonable resolution.
Revision entitlements depend on your package or project agreement.
7. Client-Initiated Cancellation
A client may request cancellation by sending written notice to our official business email.
We will review the project status and calculate any refund or outstanding amount based on the agreed payment terms, work completed, reasonable expenses incurred, and applicable law.
Where a deposit was expressly agreed to cover reserved capacity or commencement work, its treatment will depend on the contract and applicable law. A deposit is not automatically non-refundable merely because it is labelled a deposit.
8. Cancellation by Nominal Designs
If we cannot continue a project for reasons within our control, we will notify the client and discuss an appropriate resolution.
Depending on the circumstances, this may include completing outstanding work, arranging an agreed alternative, or refunding the portion of fees attributable to services not provided.
We will handle such situations fairly and in accordance with the applicable agreement and law.
9. Client Inactivity or Delayed Feedback
Clients are expected to provide the materials, approvals, and feedback reasonably required to complete their projects.
If a client becomes unresponsive, we may send a written reminder and provide a reasonable deadline for a response. If the client remains inactive, the project may be paused or treated as inactive under the agreed project terms.
Any cancellation, rescheduling fee, or refund in these circumstances will be determined by the applicable agreement, work completed, disclosed expenses, and applicable law. Client inactivity does not automatically entitle either party to retain all payments without consideration of the circumstances.
10. Duplicate or Incorrect Payments
If you accidentally make a duplicate payment or are charged incorrectly, contact us with the relevant transaction details.
After verification, confirmed duplicate or erroneous charges will be corrected or refunded as appropriate.
11. Refund Processing
Approved refunds will normally be sent to the original payment method where possible.
We aim to initiate approved refunds within 7–14 business days after confirmation. The time required for the funds to appear in your account may depend on the bank, card issuer, or payment provider.
If the original payment method is unavailable, we may request reasonable information to arrange a lawful alternative.
12. Chargebacks and Payment Disputes
If you have a concern about a payment, please contact us before initiating a payment dispute where reasonably possible. We will review the issue and attempt to resolve it promptly.
This request does not restrict your legal rights to dispute a transaction with your bank, card issuer, or payment provider.
13. Third-Party Marketplace Purchases
If you purchased our services through a platform such as Upwork or another marketplace, the applicable marketplace payment, cancellation, and dispute procedures may govern your transaction.
Please submit requests through the relevant platform where required.
14. Statutory Rights
Nothing in this policy excludes, restricts, or replaces consumer rights that cannot lawfully be waived or limited.
Where mandatory consumer protection laws provide a right to a refund, cancellation, repair, replacement, or other remedy, those rights will apply.
